Kinexion provides a technology platform that delivers movement analysis, educational insights, and user-directed tools. Kinexion is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. Kinexion is not acting as a covered entity or business associate under HIPAA.

This Privacy Policy describes how Kinexion collects, uses, stores, and shares information in connection with the platform, including how we communicate with you by email and text message (SMS).

Kinexion may collect the following categories of information:

• Name and contact information, including email address and mobile phone number

• Responses to questionnaires or inputs

• Information you choose to share through the platform

• Video or sensor-based movement data

• Range of motion estimates and generated results

Movement data may include biometric identifiers as defined under certain state laws. Such data is processed solely to generate your movement analysis results and to improve platform accuracy. Identifiable movement data is not shared without your explicit permission.

• Device type, browser type, IP address

• Platform usage, interactions, and session data

Kinexion does not require submission of medical records or clinical documentation.

Kinexion uses information to:

• Provide movement analysis results and platform functionality

• Improve performance, accuracy, and user experience

• Conduct internal analytics and product development

• Support customer service and onboarding

• Communicate with you by email and SMS as described in Sections 4 and 5

Kinexion does not use data to provide medical care or clinical decision-making.

By providing your email address, you agree that Kinexion may send you the following categories of email:

Account confirmations, password resets, security alerts, billing notices, movement analysis result notifications, Routing updates, and other messages necessary to operate your account. These messages cannot be opted out of while your account remains active.

Product updates, educational content, promotions, surveys, and newsletters. You may opt out of these messages at any time using the unsubscribe link in any marketing email or by emailing Andrew@kinexion.net.

Kinexion complies with the CAN-SPAM Act and applicable email marketing laws. Unsubscribe requests are honored within 10 business days. Kinexion does not sell or rent your email address to third-party marketers.

By providing your mobile phone number and opting in (for example, by checking a consent box, replying YES, or entering your number into a Kinexion SMS sign-up form), you give Kinexion express written consent to send you recurring text messages, including messages sent using an automatic telephone dialing system, even if your number is on a federal or state Do-Not-Call list. Consent to receive marketing SMS is not a condition of purchase or of using the Kinexion platform.

• Transactional SMS: account verification codes, security alerts, movement analysis result notifications, appointment reminders, and Routing updates from licensed providers you have chosen to connect with.

• Marketing and Educational SMS: product announcements, educational content, promotions, and surveys (only if you have separately opted in).

Message frequency varies based on your account activity and preferences. You may receive up to 10 messages per week.

Message and data rates may apply. Kinexion does not charge you for SMS, but your wireless carrier may. Contact your carrier for details about your plan.

You may opt out of marketing SMS at any time by replying STOP to any text message. You will receive a confirmation that you have been unsubscribed and will not receive further marketing messages. To re-subscribe, reply START or sign up again through the platform.

Kinexion SMS is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who support Kinexion services (such as SMS infrastructure or customer service vendors) is permitted under contractual confidentiality and data protection obligations. All other use categories described in this Privacy Policy exclude SMS originator opt-in data and consent; this information will not be shared with any third parties.

Kinexion does not sell, rent, or share personally identifiable information with third parties without your explicit permission, except where required by law.

If you choose to be Routed to a licensed provider through Kinexion, Kinexion will share only the information you authorize, such as your name, contact details, and relevant movement analysis results, for the purpose of follow-up or scheduling. Kinexion does not assign, direct, or require selection of any provider.

Kinexion may use and share data that has been de-identified or aggregated such that it cannot reasonably be used to identify an individual. This may be used for analytics, reporting, product development, or other business purposes.

Kinexion may share information with vendors who help operate the platform (hosting, analytics, payment processing, customer support, SMS and email infrastructure), bound by contractual confidentiality and data protection obligations.

Kinexion may disclose information if required to comply with applicable law, legal process, or to protect the rights, safety, or integrity of the platform and its users.

• Personally identifiable information is retained while your account is active or as necessary for legitimate business or legal purposes.

• Users may request deletion of their personal data at any time.

• De-identified data may be retained indefinitely and is not subject to deletion.

• SMS and email consent records are retained for the period required by applicable law to demonstrate compliance with consent requirements.

You may:

• Request deletion of your personal data

• Request access to your data

• Opt out of marketing email and SMS communications at any time

Upon verified request, Kinexion will delete or irreversibly de-identify your personally identifiable information within a commercially reasonable timeframe, except where retention is required for legal, security, or compliance purposes. Once data is de-identified, it cannot be re-associated with you.

Residents of California, Virginia, Colorado, Connecticut, Texas, and other states with comprehensive privacy laws may have additional rights under applicable state law, including the right to non-discrimination for exercising these rights.

Kinexion uses reasonable administrative, technical, and physical safeguards to protect information from unauthorized access, disclosure, or misuse. No system can be guaranteed to be completely secure.

If you choose to share your information with a provider, that provider will handle your information in accordance with their own privacy practices. Kinexion is not responsible for the privacy practices of third-party providers.

Kinexion is not intended for use by individuals under the age of 18 without appropriate supervision or consent where required by law. Kinexion does not knowingly collect personal information from children in violation of applicable law.

Kinexion may update this Privacy Policy from time to time. Updates will be reflected by a revised “Last Updated” date. Continued use of the platform constitutes acceptance of the updated policy where permitted by law.
